Cannabis laws in South Beach FL

If you are going to be visiting South Beach in the near future, it is important that you are aware of the cannabis laws. This area of Miami has a reputation for being pretty progressive when it comes to marijuana, but there have been some recent developments. 

Recreational Marijuana 

It is important to keep in mind that recreational marijuana is still not legal anywhere in the state of Florida. If you are caught in possessing of 20 grams of cannabis or less, you could be charged with a misdemeanor. This also comes with a maximum fine of $1,000. Even being caught in possession of cannabis paraphernalia is a misdemeanor with the same punishment. 

If you are caught with over 20 grams of marijuana, you could be charged with a felony. This comes with a sentence of up to seven years in jail and a maximum fine of $50,000. 

Medical Marijuana 

It is legal to possess marijuana in Florida if you have documentation for medicinal use. Some of the conditions that are recognized for this include cancer, epilepsy, glaucoma, Parkinson’s disease, Crohn’s disease, and multiple sclerosis. 

You can get up to 2.5 ounces of whole flower cannabis about once every month. Medicinal marijuana users cannot be in possession of more than four ounces at a time. Only terminal patients can use medicinal marijuana under the age of 18. 

Public Cannabis Use 

A recent law that was passed in September of 2019 made it illegal to smoke marijuana in public places. This includes beaches, parks, and sidewalks in South Beach. A police officer can ask you to put out whatever you are smoking. If you refuse to comply, you could be put in jail for 60 days with a maximum $500 fine. 

It is important to keep in mind that public use of medicinal marijuana in the form of edibles is still allowed. 

Legal Cannabis 

You can legally use cannabis products in South Beach as long as they contain 0.3% THC or less. These CBD products have grown quite a bit in popularity over the years. This includes vape juices/e-liquids, extracts, etc. 

If you are going to use CBD openly while in South Beach, it is important that you check the THC content of the products beforehand.

Only medicinal marijuana is legal in South Beach, but you cannot smoke it in any public spaces. Recreational cannabis is still illegal, both by state and federal laws. Cannabis products that contain 0.3% THC or less are legal. This is a bit of a legal grey area, so you will be taking a risk no matter what by using cannabis in public places.
